Terms of Service
Short version: These are the ground rules for using Deestech apps and this website. Use them for their intended purpose, don't misuse them, and understand they're provided as-is. You own everything you create with them.
1. Who these terms are with
These Terms of Service ("Terms") are an agreement between you and DEESTECH HOLDINGS LLC ("Deestech", "we", "us"), a New Jersey limited liability company. They govern your use of the deestechholdings.com website and the Deestech family of applications (each, an "app", together the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Some apps are sold through, and are also subject to, the terms of the app store you download them from (such as Apple's App Store or Google Play). Where an app has its own additional terms, those apply alongside these.
2. Using the Services
You may use the Services for your own lawful purposes. You agree not to:
- break the law, or infringe anyone's rights, using the Services;
- reverse-engineer, decompile, or attempt to extract source code except where the law expressly permits it;
- resell, redistribute, or commercially sublicense an app except as we allow;
- interfere with, disrupt, or attempt to gain unauthorized access to the Services or their supporting systems.
3. Your content is yours
Anything you create with our apps — your recordings, notes, projects, and files — belongs to you. Our apps are built to keep that content on your device; we do not claim any ownership of it and, as described in our Privacy Policy, we generally never receive it. You are responsible for your own content and for keeping your own backups.
4. Our intellectual property
The Services themselves — the software, design, branding, names, logos, and text — are owned by Deestech or our licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. These Terms do not transfer any of our intellectual-property rights to you.
5. Purchases
Some apps are free; some offer paid features or a one-time unlock. Where an app is paid or offers in-app purchases, the transaction is processed by the relevant app store, and that store's payment, refund, and subscription policies apply to it. Prices and features may change over time.
6. Availability & changes
We work to keep the Services available and working well, but we may add, change, suspend, or discontinue any part of them at any time. We may also update these Terms; when we do, we will revise the effective date above, and your continued use of the Services after a change means you accept the updated Terms.
7. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. You are responsible for backing up your content.
8. Limitation of liability
To the fullest extent permitted by law, Deestech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of the Services. To the extent we are found liable, our total liability will not exceed the amount you paid us for the app in question in the twelve months before the claim (or, for a free app, US $50). Some jurisdictions do not allow certain of these limitations, so some may not apply to you.
9. Indemnity
You agree to indemnify and hold Deestech harmless from claims arising out of your misuse of the Services or your violation of these Terms or of applicable law.
10. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction, unless applicable law requires otherwise.
